(Please read the user agreement below carefully. Lemon8Games allows you to access and use the game content and services provided only if you accept this agreement. By clicking the “I Accept” button and/or using or accessing any of the platform's content and services, you acknowledge that you have read, understood, and agreed to be bound by these terms.)

 

1. PARTIES TO THE AGREEMENT

1.1. The parties to this User Agreement are the company "Lemon8Games Software Technology Advertising Marketing Limited Company" and the "User".  

1.2. In this agreement, Lemon8Games and the User shall be referred to individually as "User" and "Lemon8Games", respectively, and collectively as the "Parties".

1.3. "Lemon8Games" refers to the company Lemon8Games Software Technology Advertising and Marketing Ltd. Şti.

1.4. "User" refers to any natural or legal person who, either by registering as a member or without registration, accesses the Lemon8Games Site and fully or partially, temporarily or permanently, obtains or benefits from any product and/or service offered on the Lemon8Games Site, whether on their own behalf or for another person or institution.

The User's status, rights, and obligations are subject to the conditions set forth below, except in cases of unauthorized access.

1.5. The term "Site" refers to the official Lemon8Games website: (www.playlemon8.com).

 

2. SUBJECT OF THE AGREEMENT

2.1. This agreement ("User Agreement") establishes the terms and conditions for the use and access to the games, applications, website (www.playlemon8.com), and other services provided by Lemon8Games. The provisions outlined below define the terms of use for all types of games and digital content that are published on, accessible through, or require login with Lemon8Games User Account credentials on the www.playlemon8.com site.

Additionally, this agreement regulates the terms of use applicable to all data, products, and services offered or sold on the Site, as well as the contractual terms governing the interaction between the User and the publisher of the Site, Lemon8Games Software Technology Advertising Marketing Limited Company, in connection with the use of the Site or its content, either directly or indirectly.

The Lemon8Games site is intended solely for entertainment purposes. It may not be used for commercial purposes, profit generation, or any similar objective. The User acknowledges and agrees that they may only use Lemon8Games services and content for non-commercial and personal purposes.

2.2. Lemon8Games reserves the right to partially or fully update and modify the terms of this agreement due to changes in the site's content, updates to offered products or services, the introduction of new products or services, or similar reasons.

The company, at its sole discretion, may change, amend, or update this agreement, as well as the Privacy Policy and User Agreement, across all its products and services. These changes will be published on the Site and Applications and will become effective from the date of publication.

Users agree to regularly review the Site and Applications to stay informed about any possible corrections or revisions to this agreement and related policies and regulations.

By continuing to use the games, services, or other related content after the effective date of any modifications, users are deemed to have accepted all changes. Users who do not agree to the revised terms and conditions have the right to close their accounts at their own discretion.

2.3. The User cannot claim, request, or declare that they were not informed of or that the changes or updates made by Lemon8Games do not or should not apply to them if Lemon8Games has directly notified them, or if they have accessed the Site after the changes or updates took effect, or if they have directly or indirectly benefited from any content on the Site after the changes or updates were implemented.

 

3. PROHIBITION OF UNAUTHORIZED ACCESS

3.1. The User is not permitted, under any circumstances, to temporarily or permanently share their Lemon8Games account access credentials or any other authorizations with a third party.

If such unauthorized usage is detected, Lemon8Games reserves the right to identify the individual(s) who accessed the account and may permanently or indefinitely suspend the relevant account, thereby terminating its use.

3.2. The account holder is solely responsible for any consequences resulting from allowing others to use their account. In such cases, individuals who, in any manner, partially or fully, temporarily or permanently, use another person's User account cannot assert any rights or claims against Lemon8Games.

The services provided under this Agreement are exclusively for the User's personal use and are subject to a non-exclusive, revocable, and non-transferable license for service usage.

Users may not sub-license, rent, lease, lend, or transfer the software or services in any way. Furthermore, they may not modify, adapt, reverse engineer, extract source code, or use the software or services in any manner other than as explicitly stated in this Agreement.

3.3. Unauthorized access and usage may be subject to legal sanctions before the competent authorities to the extent that they are deemed unlawful. 

3.4. The User acknowledges and undertakes that they are aware of the aforementioned legal sanction risk and that they assume joint and several liability for the consequences together with the persons to whom they have allowed access to their account. Persons who use User accounts without authorization are liable to Lemon8Games either jointly with the account holders or individually under this agreement; however, it is not possible for these persons to claim or assert that they are parties to this agreement.

3.5. Unauthorized access and unauthorized use of another person's account do not grant the person performing such actions the rights or status of a "User" as defined in this agreement. On the contrary, those who engage in such actions are deemed to have acknowledged and undertaken, together with the User, that they will be subject to the obligations imposed on the User by this agreement in relation to Lemon8Games.

3.6. This Agreement shall in no way be construed as establishing any form of cooperation, partnership, or any other legal relationship between the parties, nor shall it be interpreted as a legal transaction that results in the transfer of any rights from Lemon8Games to the User under any name or title.

3.7. Due to unauthorized access and other unlawful acts mentioned above, the User and the unauthorized individuals or entities shall be personally and jointly liable for any damages incurred by Lemon8Games. All compensation rights of Lemon8Games in this regard are expressly reserved.

 

4. Establishment and Effectiveness of the Agreement

4.1. This Agreement is legally binding upon the parties from the moment the User accesses the Lemon8Games Site, whether as a member or without membership, by creating an account or without creating one, and regardless of the duration of transactions, visits, membership, or other interactions with any Lemon8Games content available on or through the Site. From that moment, the Agreement is deemed to have been read, understood, and accepted by the User and thus comes into effect.

4.2. After its establishment, the Agreement remains legally binding and in effect for as long as the User accesses the Site and benefits from its content in any manner.

4.3. If the User wishes to terminate the effectiveness of the Agreement, they may request it by first closing their user account, if applicable, then notifying Lemon8Games in writing, and from that moment onwards refraining from accessing the Site in any manner. 

Lemon8Games reserves the right to temporarily or permanently suspend the User's account(s) or to immediately terminate the Agreement without any obligation of payment or prior notice if the User is found to have engaged in any actions or transactions that partially or fully violate the terms of the Agreement. Following such termination, the User shall be liable for any damages that Lemon8Games may incur.

4.4. Lemon8Games has the right and authority to make partial or complete modifications, amendments, additions, and updates at any time and without any limitations regarding duration or scope, as required by technological advancements used on the site, innovations and improvements to be introduced, new products and content, obligations mandated by legislative changes, updates, and partial or comprehensive changes to existing products, services, and content.

 

5. INTELLECTUAL PROPERTY

5.1. All games, content, and services, as well as any kind of service and content provided through the website www.playlemon8.com, are solely and exclusively owned by Lemon8Games Software Technology Advertising Marketing Limited Company.

5.2. All platforms, games, and the content and/or services of Lemon8Games accounts, including but not limited to text, graphics, user interfaces, visual interfaces, software, source code, APIs, photos, sounds, music, videos, interactive features, trademarks, logos, and their arrangements, are owned by Lemon8Games and are under its protection. They are safeguarded by applicable intellectual and industrial property laws as well as other relevant legislation in force.

The User agrees not to copy, modify, lend, sell, rent, license, download, process, reproduce, distribute, transmit, publish, display, create derivative works from, or utilize the content for any purpose.

5.3. Content lawfully acquired by the User may be used only within the framework of the terms and conditions determined by Lemon8Games; however, such acquisition does not grant ownership rights over the content. In this regard, the general provisions of Law No. 5846 shall apply.

No provision of this Agreement or the purchase of any Lemon8Games product grants the User ownership of any content or any additional rights or licenses over the content. Any content, product, or service acquired through Lemon8Games allows the User to use the content solely for personal use and within the boundaries of good faith, and the User acknowledges and accepts this condition.

Any content accessed, acquired, or used by the User through the Site is the exclusive intellectual property of Lemon8Games. The rights and authority to determine the usage duration, validity period, and termination of any content belong solely to Lemon8Games.

5.4. All products, services, or content acquired by the User from the Lemon8Games Site must be used in accordance with the characteristics of the respective item, the applicable terms of use, the principles determined by Lemon8Games, and relevant legal regulations. If Lemon8Games detects any usage that violates these conditions, it has the right to terminate such usage and take necessary actions against those responsible, in accordance with the extent and procedures required by legal regulations.

5.5. The right to use any content acquired by the User from the Lemon8Games Site belongs exclusively to the User who lawfully obtained it, subject to the applicable terms of use of the respective content. If the User commercializes, uses the content for profit, or allows third parties to use it, they shall have no right to make any claims against Lemon8Games regarding the content in question.

5.6. The User may utilize any content acquired from the Lemon8Games Site only for the purpose for which it was provided and obtained. Any processing, modification, disassembly, reproduction, copying, or other actions aimed at utilizing the content for purposes beyond its intended acquisition are considered a violation of this Agreement. The User acknowledges and accepts that engaging in such actions will be deemed unlawful and may result in legal investigation, prosecution, monitoring, and other legal procedures against the responsible parties.

5.7. Some content or products may be offered only for a limited period. Therefore, the User agrees, declares, and undertakes not to use, continue, access, copy, distribute, share, disclose, or make the content accessible to third parties in any way after the expiration of this period.

The User acknowledges that they are solely responsible for any such actions, even if the content or product remains available on Lemon8Games websites, news, publications, reports, games, or accounts after its expiration.

 

6. OWNERSHIP OF OTHER ACCESSED CONTENT

6.1. Through the Lemon8Games site, access may be provided to various digital platforms, websites, products, or content belonging to third parties or institutions, including advertisements. Lemon8Games has the sole right and authority to determine, without any limitations on duration or subject matter, whether and to what extent third-party content can be accessed from the site.The User agrees and undertakes that they shall not engage in any actions or transactions aimed at enabling internal or external access to content belonging to themselves or third parties through the site, nor shall they publish such content via the site or user accounts.

6.2. All methods and procedures related to enabling access to third-party content, including advertisements, whether through the Lemon8Games site or externally via redirection or other means, fall within the scope of this clause. The exclusive right to make decisions regarding these matters belongs solely to Lemon8Games. 

However, any liability arising from third-party content, including advertisements, as well as the applicable terms of use and any consequences resulting from its use or access, remain solely the responsibility of the content owners.

6.3. The obligations and ownership rights related to the use of content, publications, or other elements subject to intellectual or other property rights belonging to third parties or institutions accessible through the Lemon8Games site are the sole responsibility of their respective owners.

6.4. Accessing all third-party content available through the Lemon8Games site is at the discretion of the User. The terms of use applicable to such third-party content are determined by the respective owners. Lemon8Games does not have the authority to regulate the terms of use for third-party content accessed through its site. Consequently, Lemon8Games cannot be held liable for any damages, claims, or disputes arising from or related to these terms.

6.5. If Lemon8Games suffers any damage due to the User's unlawful actions or any conduct that causes harm or disputes related to third-party content accessed through the Lemon8Games site, Lemon8Games reserves the right to seek recourse against the User.

 

7. RESPOSIBILITY OF THIRD PARTIES

7.1. The User may not make any claims, file lawsuits, or attribute any liability to Lemon8Games—whether directly, indirectly, individually, or jointly with the rightful owners—due to any content or publications belonging to third parties or institutions, including advertisements, that are accessed through the Lemon8Games site. 

The User acknowledges and undertakes that Lemon8Games bears no legal responsibility for any content or publications belonging to 3rd parties or institutions, including but not limited to advertisements, accessed through the Lemon8Games portal.

7.2. The User, by using the services, games, content, and other offerings provided through the Lemon8Games Site, which are protected by intellectual property, trademark, design, and other legal regulations and whose intellectual and industrial property rights belong to Lemon8Games, shall be deemed to have been informed of the obligations stated in this Agreement and to have undertaken to comply with them by accepting this Agreement.

7.3. A User who does not accept the provisions of this Agreement or the terms of use of the site and its content must leave the Lemon8Games site and refrain from using or attempting to use any services or products offered on the site. Otherwise, the User shall be deemed to have accepted and agreed to the provisions of this Agreement.

7.4. The individuals who create and publish content in forums, profiles, blogs, news sections, or similar areas of the Lemon8Games site, where users can generate and share content, are solely and fully responsible for their respective content. Lemon8Games cannot be held liable for any such content.

 

8. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

8.1. The trademarks and other identifiers used by Lemon8Games in offering site content to users are the exclusive property of Lemon8Games, either through registration with authorized regional or international official bodies, through their distinctive characteristics, or by having acquired distinctiveness through use.

8.2. This Agreement does not grant the User and/or any third parties any partial or full ownership rights over the elements and identifiers that are the exclusive property of Lemon8Games. It only provides a limited right of use concerning the relevant content.

8.3. The User acknowledges and accepts that all games, content, materials, documents, information, graphics, designs, products, in-game accounts, in-game items, email services, software, updates, and other similar services provided through the Lemon8Games site are protected under Law No. 5846 on Intellectual and Artistic Works, Law No. 6769 on Industrial Property, and other applicable regulations.

The User has been informed that all tangible and intangible elements, assets, and/or subjects listed in this clause are, except for the exceptions stated in this Agreement, exclusively owned by Lemon8Games, and agrees not to engage in any actions or transactions that contradict this ownership.

8.4. Lemon8Games reserves the right to partially or fully, temporarily or permanently suspend, modify, or discontinue any of the services offered within its gaming services. The User agrees that they shall not make any claims against Lemon8Games in the event that the presentation of site content and services is temporarily or permanently suspended or terminated.

8.5. Lemon8Games does not guarantee the permanence or uninterrupted availability of the services or content provided on this site. This condition shall not be interpreted as partially or fully revoking Lemon8Games' ownership rights over the trademarks or identifiers related to the content or services.

8.6. In the event of temporary or permanent modifications to any part or the entirety of the games, publications, content, and other elements available on or accessible through the Lemon8Games site, Users shall have no right to make any claims or demand compensation from Lemon8Games under any circumstances.

8.7. The User acknowledges and accepts that all the assets mentioned in this clause, as well as the full rights and authority to manage them, are exclusively owned by Lemon8Games.

8.8. Individuals who use, benefit from, or attempt to access the games and/or any directly or indirectly related services provided by Lemon8Games shall be deemed aware of their personal initiatives and responsibilities through this notice.

8.9. The User declares that they accept the Lemon8Games Privacy Policy, which is an integral part of this Agreement, in addition to the terms of this Agreement. Therefore, the User undertakes to comply with the relevant laws while benefiting from the content or services of Lemon8Games. They further agree that they are solely responsible for any actions or transactions that violate the laws and acknowledge that they will have no right to seek recourse or bring any disputes against Lemon8Games for such reasons.

8.10. The User agrees not to violate Lemon8Games services and content, not to exploit vulnerabilities, not to perform reverse engineering, not to decompile, not to disassemble, not to tamper with the content in any way, and not to encourage or assist others in engaging in such activities.

 

9. ACCESS AND RESTRICTIONS

9.1. If the User utilizes the services or content of the Lemon8Games site in violation of the terms of this Agreement, Lemon8Games reserves the right to temporarily or permanently terminate the User's access to the site's services and content through the website.

9.2. If Lemon8Games exercises its rights as stated in Clause 8.4, the User shall have no right to object to this action. In such a case, the User is responsible for destroying all materials, including licenses and any other items obtained during the use of services provided by Lemon8Games.

9.3. The User may not transfer, share, or allow others to use the passwords, usernames, or any other rights granted to them for accessing Lemon8Games services. Additionally, they may not commercialize these rights, whether for compensation or free of charge. The User shall have no right to make any claims against Lemon8Games regarding the consequences of any actions or transactions in violation of this provision.

9.4. The User acknowledges and accepts that the account credentials, as well as virtual items, account balance, account character, and other account features created within their account for accessing content on the Lemon8Games site, do not have any commercial or monetary value. All assets listed in this clause are provided to the User solely for the entertainment purposes of the Site and do not serve any commercial intent. They cannot be used for betting, gambling, or any other illegal purposes.

9.5. The User acknowledges and accepts that the content provided on the Lemon8Games Site, particularly the games and all related services, are not based on luck or chance in any manner.

9.6. The User undertakes to acquire and use each service and content provided on the Lemon8Games site in compliance with its applicable terms and conditions. The User agrees not to use any unauthorized third-party tools, programs, software, or elements that violate these terms. This includes, but is not limited to, "hacks," "cheats," "bots," "cheat files," "mods," and automation programs or any unauthorized third-party software that interacts with the content or any part of its software components. The User also agrees not to use any third-party software that blocks, mimics, redirects, or interferes with communication between the software and Lemon8Games or reads memory areas used by the content to collect information about it. The User acknowledges that violating this provision may result in sanctions imposed by Lemon8Games and that such actions are unlawful, making them subject to legal proceedings.

9.7. Any applications, content, code, or other elements or data played, downloaded, or accessed through the Lemon8Games Site shall be used in accordance with Intellectual and Industrial Property Law, relevant legislation, and international agreements, as well as the terms of use stated herein. The User acknowledges and accepts that any use in violation of these regulations may be subject to criminal and legal prosecution under the applicable laws and agreements.

9.8. Lemon8Games reserves the right and authority to temporarily or permanently suspend and/or permanently close user accounts that have remained inactive for a continuous period of 6 months from the last login date.

 

10. USER CONNECTION AND HARDWARE

10.1. To access and benefit from the content and services provided by the Lemon8Games Site, Users and members must have the necessary connection infrastructure and hardware. Ensuring the availability of the required hardware and connection infrastructure and meeting the related requirements is the sole responsibility of the User. Lemon8Games holds no liability in this regard.

10.2. Any disruptions related to internet connection, whether caused by service providers, infrastructure, or the User, are solely the User's responsibility. Lemon8Games cannot be held liable for such issues.

10.3. When using the services provided by Lemon8Games, the availability and frequency of service usage shall be determined at Lemon8Games' sole discretion based on factors such as the number of active users, duration, and other relevant data.

10.4. Lemon8Games will utilize the highest possible technological measures to ensure the security of user accounts while users access and benefit from Lemon8Games services and content.

10.5. The User acknowledges and undertakes that they are primarily and directly responsible for ensuring the security of their accounts. The User further agrees that they shall have no right to make any claims against Lemon8Games in the event of account security issues arising from failure to fulfill this responsibility.

10.6. The use of Lemon8Games content and services may require compatible devices, internet access, and certain software that may incur fees. Additionally, these items may need to be updated periodically, and such updates may affect their performance. These circumstances and reasons cannot be used as a basis for making any claims against Lemon8Games. 

 

11. DISCLAIMER OF LIABILITY

11.1. Lemon8Games shall not be held liable for any temporary or permanent loss or inaccessibility of game accounts and/or any elements within those accounts that may occur due to technical issues during the provision of the games and related services.

11.2. During the use of the content and services provided by Lemon8Games, any usage involving advertisements, unfair competition, terrorism, defamation of the republic, state, religion, racism, drugs, politicians, other legal entities, pornographic content, the use of offensive language, or harassment of other players, or any actions that insult the moral memory of Atatürk, is prohibited and constitutes a violation of the rules of this Agreement. 

The User agrees and undertakes not to use Lemon8Games services and content for the purpose of transmitting, uploading, posting, emailing, transmitting, storing, or otherwise making accessible any content that is illegal, offensive, threatening, harmful, defamatory, abusive, violent, obscene, rude, an invasion of privacy, hate-filled, or discriminatory based on racial or ethnic identity, or any other form of harmful content.

11.3. In cases of violating use, the User may be temporarily or permanently deprived of access to the relevant services or content by Lemon8Games. If necessary, any related content created by the User may be shared with official authorities and agencies upon request by Lemon8Games.

11.4. Lemon8Games is only responsible for removing content that violates the law from relevant accounts or site content to the extent that its technical capabilities allow. The company is not liable to the account holder for any actions taken in this regard. For the same reasons, user information may be shared with prosecutorial authorities and law enforcement agencies based on formal requests.

11.5. If the User is prohibited from benefiting from these services and content based on the laws in their country or region, regardless of the specific date of such prohibition, Lemon8Games cannot be held liable for any resulting consequences.

11.6. Some of the content and games made available to users through the Lemon8Games site are published only for access via the site and do not have publishing or licensing rights owned by Lemon8Games. Therefore, account ownership, access rights, and any requests for information from official authorities are the sole responsibility of the publisher of the game or content. Lemon8Games does not retain any information or data related to these matters.

The User has no claim or connection to Lemon8Games regarding the games or content mentioned in this clause. Similarly, requests for information from official authorities regarding these games and content cannot be directed to Lemon8Games nor can Lemon8Games provide responses.

 

12. PRIVACY IN ACCOUNT USAGE

12.1. The User acknowledges that they are solely responsible for keeping confidential the information that provides access to their account in order to benefit from Lemon8Games services and content and agrees not to share such information with any third party or institution. The User also undertakes to immediately notify Lemon8Games of any security breach.

12.2. Lemon8Games is not responsible for any damages arising from unauthorized use of the User's account. The User agrees to carefully use and protect their account access information. The User is responsible for any damages caused to third parties and Lemon8Games resulting from unauthorized use of their account.

12.3. The User agrees to provide accurate and complete information when creating an account, registering, and using the content and services on the Lemon8Games site. The User also agrees to update their registration information to ensure it remains accurate and complete.

12.4. The User agrees that Lemon8Games may store and use their registration information to manage User accounts. The User acknowledges that they may not create an account on behalf of another person without their permission and undertakes to be solely responsible for the consequences if this condition is violated.

12.5. Lemon8Games is authorized to apply any legal, technological, and legal measures to the relevant account and User if any actions or transactions are detected that violate the commitments outlined in this clause.

 

13. CONSENT

13.1. Lemon8Games may use the User's written consent and knowledge to communicate information regarding new products/services, promotions, campaigns, etc., via email, SMS, or other communication channels.

13.2. Lemon8Games site and users consent to the processing of personal data for the purpose of receiving notifications or promotions in accordance with this clause. Users may opt-out of receiving such emails by selecting the "Unsubscribe from Emails" option.

 

14. COMPENSATION AND RECOURSE RIGHTS

14.1. The User, by agreeing to this Agreement, accepts full responsibility for and agrees to indemnify Lemon8Games from any and all lawsuits, claims, damages, losses, liabilities, and expenses arising directly or indirectly from the User's fault, misuse, or improper use of the site's content, or from any violation of the site's privacy policy or other documents and rules. The User undertakes to cover all such costs and absolve Lemon8Games from any such liabilities.

14.2. The User, at the request of Lemon8Games, agrees to indemnify the company, its shareholders, partners, affiliates, directors, employees, agents, suppliers, licensors, distributors, content providers, and other service providers from all damages, liabilities, losses, judgments, claims, or any other costs that Lemon8Games may incur due to the User's use of the service or violation of this Agreement. This includes all costs such as legal fees and expenses, and the User agrees to cover these costs and prevent any damages or losses to Lemon8Games.

 

15. DISCLAIMER OF WARRANTY

15.1. Lemon8Games does not provide any warranties to the User regarding the site and its content, including but not limited to the absence of defects, title, third-party ownership, intellectual property rights, continuity, accuracy, reliability, quality, and availability of the content. The site and its content are provided "as is", and Lemon8Games does not guarantee uninterrupted or error-free access.

 

16. PRICING AND PAYMENT

16.1. Some of the content provided on the Lemon8Games website may be paid and some may be free. Lemon8Games reserves the right to determine which content is charged or provided free of charge, for how long, and in what manner. Content that is free on the Lemon8Games site or accessible through the site may later be offered on a paid basis at the discretion of Lemon8Games or upon request by the persons or institutions collaborating in providing that content. Likewise, content initially offered as paid may later be provided at a lower price or for free, as determined solely by Lemon8Games. These changes shall immediately take effect when incorporated into this agreement or published on the website, applications, or games. In the event of such changes, Lemon8Games will inform the User via the Site with sufficient notice.

16.2. All user transactions conducted through the Lemon8Games site, and any associated fees, are solely at the User’s discretion and responsibility.

16.3. The User may choose any of the available payment options on the site, provided that they comply with the technical and procedural rules applicable to that payment method, which is the User’s responsibility. The right to determine the pricing, provision, or changes in pricing for content on the Lemon8Games site rests solely with Lemon8Games.

16.4. In transactions using the Virtual Pos/Credit Card payment option, the credit card details requested on the payment page are not stored on www.playlemon8.com or on the servers of the companies providing its services, in order to ensure the highest level of security for users shopping on the site.

16.5. Lemon8Games takes various security measures to protect your information, as detailed below. However, as complete online and offline security can never be guaranteed, you should always be cautious when sharing your information online. Lemon8Games implements various security measures to protect and keep personal information confidential (except for information that is inherently public, such as user-generated content, leaderboard rankings, and scores). In addition, measures are taken to prevent misuse or alteration of the collected personal data. Lemon8Games also strives to ensure that its suppliers, who process your personal information, take similar security measures. Nevertheless, since the internet is not inherently secure and security risks are constantly evolving (along with technology and industry standards), complete security of personal information collected, stored, or used by Lemon8Games or its suppliers cannot be guaranteed.

16.6. All credit card and personal information of the User is encrypted using the SSL Secure system, the standard for internet security. This prevents the unauthorized interception of such information during online transactions.

16.7. The validity period of L-para and any other purchase instruments used for acquiring and using content on the Lemon8Games site is determined, modified, and regulated by Lemon8Games.

16.8. L-para is a Lemon8Games-specific instrument that can be acquired and used on the site for paid content. It is not an electronic or virtual currency and is not accepted as a payment instrument by any third party. The validity period of L-para is one (1) year from the date it is acquired by the User for security purposes. If L-para is not activated and/or used within one year of acquisition, it cannot be activated or used after this period. At the end of the one-year period, if the User wishes to reactivate and use the unusable L-para, they may submit an activation request in writing to Lemon8Games, providing the acquisition date, amount, reason for non-use within the validity period, and their identification details. If, upon review, Lemon8Games determines that the request is valid and free of suspicion, it may approve the request. The period during which the User may submit such an activation request is at most one (1) year following the initial one-year period.

16.9. Except as otherwise provided by law, all fees and other charges (including Game Currency) for services that are fully or partially paid must be paid in advance and are non-refundable.

16.10. Lemon8Games is not liable for any consequential damages resulting from the User’s payments on the site.

 

17. CONTENT SUITABILITY

17.1. The determination of whether any game, broadcast, content, or other elements provided on the Lemon8Games site or accessed through it are suitable for specific age groups is left to the players. While Lemon8Games is not bound by official evaluations regarding age suitability, it may share such evaluations if provided by the relevant official authorities.

17.2. If the User is under the legal age threshold, it is strongly recommended that they notify their legal guardians about the content or game, inquire about its suitability for their age group, and obtain their approval before using or continuing to use the content or game.

17.3. The User confirms that they meet the specified age requirements for the product and are fully capable of accepting the terms, obligations, declarations, and responsibilities stated in this agreement. The User agrees to comply with and implement this agreement properly.

17.4. Depending on the applicable age restrictions or limitations, the User must either (i) be an adult or (ii) if underage, have been declared legally mature or obtained valid consent from their legal guardians regarding this agreement. By accepting this agreement, these conditions are considered to be met, and the User accepts the terms of use and the Lemon8Games privacy policy. Lemon8Games is not responsible for verifying or investigating whether these conditions are met.

Corporate entities such as companies, limited liability companies, partnerships, or other corporate or commercial entities cannot create accounts. Individuals who are prohibited by Lemon8Games from using the product are not allowed to create or use accounts. By accepting this agreement, the User represents and warrants that they meet these criteria.

17.5. Parents acknowledge and accept that they are fully responsible for all uses of the minor’s account. This document does not restrict Lemon8Games’ right to suspend, terminate, or delete an account.

17.6. The use of the content and services provided on the Lemon8Games site does not guarantee any legal relationship or commitment between the User and any other person or institution, and any interpretation suggesting otherwise is rejected by Lemon8Games. While Lemon8Games takes care to secure all data related to User claims, it is not liable for breaches resulting from improper behavior, unauthorized access, or other situations specified in this agreement.

 

18. HEADINGS AND INTERPRETATION

18.1 The headings used in this agreement are provided solely for ease of reading and understanding. The headings shall not be taken into account when interpreting the agreement and do not create any legal effect.

 

19. PARTIAL INVALIDITY

19.1 If any provision of this agreement is found to be invalid or unenforceable for any reason, that provision shall be reformed by Lemon8Games to the maximum extent possible so as not to affect the parties’ intentions, and the remainder of the agreement shall continue in full force and effect. However, if it is determined that the provision cannot be reformed, that provision will be considered severable without affecting the validity and enforceability of the remaining provisions.

 

20. LIMITATION OF LIABILITY

20.1. Under no circumstances, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if Lemon8Games is aware or should have been aware of the situation, shall Lemon8Games be liable to any third party for any direct, indirect, incidental, consequential, personal, punitive, or multiple damages or losses arising from the use or misuse of the Lemon8Games site and its content.

20.2. The User acknowledges that the service, software, content, games, and all other services are provided on an “as is” and “as available” basis, and that the use of the service is entirely at the User’s own risk and responsibility. Neither Lemon8Games nor any other service provider guarantees that the service will meet the User’s requirements or that it will be uninterrupted, timely, secure, or error-free. Furthermore, neither Lemon8Games nor any other service provider provides any express or implied warranty, including warranties of merchantability, fitness for a particular purpose, or non-infringement regarding the quality, security, or accuracy of the information or materials obtained through the service.

Lemon8Games does not guarantee that any software errors will be corrected or that the website or its servers are free from viruses or other harmful elements. The User acknowledges and accepts that any material or data obtained or downloaded through the service is at their own risk, and that any loss or damage to their computer system resulting from such downloads is solely their responsibility.

Unless expressly stated otherwise in this agreement, no advice or information provided—whether orally or in writing—by Lemon8Games or any other service provider is guaranteed. Without limiting the foregoing, Lemon8Games does not warrant the continuity, error-free operation, security, or virus-free nature of the service, software, or games, and the User understands and accepts that they are not entitled to a refund if Lemon8Games fails to meet these guarantees.

20.3. Should any third party infringe upon the rights and authorities that the User possesses under this agreement, the User shall have the right to seek compensation, initiate legal action, or file a complaint against the infringers. In such cases, Lemon8Games will support the User by providing any digital data and evidence within its possession—which is deemed conclusive evidence—if requested by the relevant authorities or official bodies within the legally mandated retention period.

20.4. Under no circumstances shall the User be entitled to claim an amount exceeding the individual payment amount in any claim against Lemon8Games.

 

21. FORCE MAJEURE

21.1. Lemon8Games shall not be liable for any delays or failures to perform its obligations under this agreement due to force majeure events, such as natural disasters, war, terrorist attacks, uprisings, embargoes, actions by civil or military authorities, fires, floods, accidents, strikes, transportation restrictions, or shortages of fuel, energy, labor, or materials, which are beyond its control and, even if foreseeable, are extremely difficult to prevent.

 

22. ASSIGNMENT AND TRANSFER

22.1. The User may not assign or transfer, directly or indirectly, any rights or authorities held under this agreement or relating to the services or content provided on the Lemon8Games site to any third party without the written consent of Lemon8Games, regardless of whether the rights are proprietary.

22.2. Lemon8Games may, at any time and in whole or in part, transfer or assign any rights, obligations, or liabilities arising from this agreement or related to the site’s content to any third party, provided that the User is notified.

 

23. PRIVACY

The Policy on the Use and Protection of Your Personal Data, along with the Disclosure Statement regarding the processing and protection of personal data, is currently published on www.playlemon8.com.

 

24. JURISDICTION

24.1. All disputes arising from or related to the implementation of this agreement shall be finally resolved through arbitration in accordance with the Arbitration Rules of the İzmir Enforcement Offices and the Turkish Bar Association Arbitration Center. The arbitration shall take place in Ankara, Turkey; the language shall be Turkish; there shall be one (1) arbitrator; and Turkish law shall apply.

 

25. CONCLUSIVE EVIDENCE

25.1. In resolving any disputes arising from the execution of this agreement, the records and books of Lemon8Games shall be deemed conclusive evidence.

 

26. INTERPRETATION OF THE AGREEMENT

26.1. The acceptance of this agreement by the User, the conclusion and implementation of this agreement between Lemon8Games and the User, or the use of the Lemon8Games site or its content by the User does not create any joint venture, partnership, employment, or agency relationship between the parties, and no such relationship shall be inferred. This agreement shall not affect any previously concluded contractual relationships between the parties, insofar as they do not conflict with the provisions of this agreement.

 

27. NON-WAIVER

27.1. The failure of Lemon8Games to enforce any provision of this agreement shall not be interpreted as a waiver of that provision, neither now nor in the future, nor shall it affect either party’s right to enforce that provision or any other provision.

27.2. A definitive waiver by Lemon8Games of any provision or condition of this agreement does not constitute a waiver of its right to enforce that provision or condition in the future.
